1. INTRODUCTION & ACCEPTANCE
These Terms of Service ("Terms") constitute a binding legal agreement between you ("User", "you") and AMCAcademic, operated by DAFNE TECHNOLOGIES ("Company", "we", "us", "Platform"), a New Zealand-based entity. By creating an account, accessing content, making a payment, or using the platform in any way, you accept all terms and conditions outlined herein. If you do not accept these Terms in their entirety, you must not use AMCAcademic. Your use of the platform constitutes your acceptance of these Terms and our Privacy Policy.
2. GLOBAL PLATFORM & JURISDICTION
AMCAcademic is based in New Zealand and globally accessible. 3. GOVERNING LAW & JURISDICTION
These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to conflict of law principles. Subject to clause 3.2 below, any legal proceedings arising from these Terms shall be
resolved in the courts of New Zealand. However, NOTHING IN THESE TERMS OVERRIDES YOUR RIGHTS UNDER APPLICABLE CONSUMER PROTECTION LAWS. If local law requires disputes to be resolved in your local courts or under your local law, you may bring legal proceedings there. Your rights under:

(b) Fair Trading Act 1986 (NZ),
(c) Australian Consumer Law,

Before initiating legal proceedings, the parties agree to attempt resolution through:
(1) Good faith negotiation for 14 days,
(2) Mediation (if both parties agree) for 30 days,
(3) Legal proceedings as a last resort.
All notices regarding disputes must be sent to the other party in writing and shall be deemed received when delivered personally, sent by email with confirmation, or posted by registered mail (5 business days after posting).

If you believe our service is not of acceptable quality, not fit for purpose, or breaches any consumer guarantee under laws in your country, you may be entitled to a refund, replacement, or repair regardless of this policy. These statutory rights CANNOT be excluded or limited.
